Cultural Forum: Indonesia Need to Apply Prophetic Law E-mail

ImageOne of pathethic condition happening in this country was dehumanization. A condition where human, who has both physical and spiritual dimensions, was not postured as it should be. In Indonesia, human was postured as development production machine that always been exploited and taught to be hedonist.

It was ironic if we saw that Indonesia had the lowest ranking in terms of research in South East Asia. While from research result showed that Indonesia ranked first country that recently active in building shopping center. Whereas shopping center was a symbol of inhumane modern capitalism.

This statement was revealed by Dr. Busyro Muqoddas, SH., M.Hum, lecturer at Faculty of Law, Universitas Islam Indonesia who was the speaker at Sarasehan Budaya (Cultural Discussion Forum) held by takmir masjid al-Azhar FH UII on Friday (3/30). He who is also Vice Chairman of Commission of Corruption Eradication (KPK) affirmed several solutions to deal with that matter.

Dr. Busyro Muqoddas proposed to bring Indonesian law into prophetic law containing moral teaching. It is hoped that the law can reflect moral values adopted from moral life of the prophet Muhammad. “Our country needs to apply prophetic law.” He emphasized.

According to him, it seems difficult to combine prophetic consciousness. Besides, he mentioned several tips to endure this matter. “We have to contemplate and imagine, not just memorizing textual meaning. Hence, the text must be reflected in current context. Meanwhile, the spirituality of law enforcement must be strengthened by fasting for example.” Busyro said further.

Meanwhile, UII Vice Rector I, Nandang Sutrisno, SH LLM MHum PhD attending in this discussion stated that prophetic law could no be implemented in Indonesia if this context was still formulated with formal text. Still according to him, to formulate this idea becoming reality, it is essential to employ cultural approach. “Also, we need to hire smart individual who has integrity to formulate the concept of prophetic law.” He added.

Besides, Dean of Faculty of Law, Dr. Rusli Muhammad, SH. MH, was certain that the concept of prophetic law can be applied in Indonesian law. The prophetic law can be executed in three different areas including in legal institutions, legal norms, and legal culture.

In this occasion, Emha Ainun Najib who performs with his music group Kiai Kanjeng also highlighted that the guy who will implement the concept of prophetic law were expected to always find the real truth to enforce the law.
